Marina Berth owners in Cap Ferrat, Beaulieu, Cap d'Ail and Menton - Losing the right to rent out

It now appears, in the world of South of France port and marinas, that local authorities - embodied by CUNCA - are about to take from berth owners, or individuals owning shares in private marinas, their right to use a berth and rent it out.
This news came through in early 2010, with a circular sent to all the share holders. Apparently CUNCA has reinterpreted a point of general marina rules and state that marina shareholders who do not own a boat that usually moors on that berth (i.e. they don't use it themselves) lose their right th the berth. In fact, the word is they will keep the right to pay service charges and lose all right to rental income, as of January 2011.

This is clearly an devised to clamp down on marina berth speculation and push berth prices on the Côte d'Azur down to affordable levels for more boat owners.

Who here thinks it will work? Is it really going to solve situation? Who thinks it could spread to the whole coastline? Is anyone reading this thread feeling the affect of this change (i.e. if you are a berth owner for instance)?

I would really appreciate your point of view. We have written a summary of our findings on http://www.inwardsmarine.com/services/Know-your-Berth-Rights.asp should you like to read more.
